DST Chapter 15

Chapter 15 Copyright and Fair Use in Education

When in doubt ask a lawyer. There are so many legal things to consider when creating a video. Just as books have a copyright, videos do as well. It is better to be safe than sorry.  Even if the copyright symbol is not there, assume that it exists.

Three rules of respect: (1) citation, (2) permission, and (3) compensation. I think that they three rules of respect allows the media users to follow rules that would be appropriate when using someone else’s  work. Just as if we were to use someone else’s words from text, we would do the same with other media types and acknowledge the original creator.

Four-Factor Fair-Use Test: (1) What will be the video be used for?  (2) What is the nature of the work? (3) How much will be used?  and (4) Will is effect market value of the media? This is another way to determine if the media that an adult or student uses is appropriate.

Best advice is to use media that is created by you or a friend. There are many grey zones, try to avoid them as best as possible.

  1. I guess that means we need to have a lot of creative friends!

  2. but seriously, what I like about the three rules is that it is generally respectful. I think as we go forward with all of the content out there on the internet, a guideline of being respectful of intellectual property will be good for our students regardless of copyright. I think people today do not think about copyright at all unless they get in trouble.
